This User Agreement (hereinafter — the "Agreement")

is a public offer in accordance with the Civil Code of the Republic of Kazakhstan and defines the terms of use of the website https://voyagecurated.com/ (hereinafter — the "Site") for the purchase of digital travel guides (hereinafter — the "Guides").
The rightholder of the Site and of the exclusive rights to its content is individual entrepreneur Enchova Akdana Sarzhanovna, hereinafter — the "Provider."
By using the Site, you confirm your agreement with all the terms of this Agreement. If you do not agree, you must stop using the Site.
Visitors to the Site acknowledge and understand that the Guides presented are compiled from the Provider's personal experience and views and may not satisfy all the requirements and wishes of Visitors/Users/Buyers.

1. Basic TermsSite Visitor — a person browsing the Site without the intention of placing an Order.
User — a person who accepts the terms of the Agreement.
Buyer — a User who has paid for a Guide.
Order — a formalized intention to purchase a Guide.
Offer — a proposal to purchase a Guide.
Acceptance — agreement with the terms of the proposed Offer.

2. Acceptance of the Agreement2.1. Acceptance is any use of the Site's functionality.
2.2. The Agreement takes effect for the User from the moment of Acceptance.
2.3. Agreement with the terms of the offer is the response of the person to whom the offer is addressed, indicating its acceptance. Such agreement is full and unconditional. By agreeing to the terms of this Offer, the Customer confirms their legal capacity and competence, as well as their lawful right to enter into contractual relations with the Provider. Full and unconditional Acceptance is constituted by registering on the Site and/or making the payment provided for by the Agreement.

3. General Terms3.1. The User is obliged to review the text of the Agreement before beginning to use the Site.
3.2. Use of the Site without agreement to the Agreement is not permitted.
3.3. The Provider has the right to amend the Agreement unilaterally.
3.4. The new version takes effect from the moment it is posted on the Site.
3.5. The text of this Agreement constitutes a public offer (in accordance with paragraph 5 of Article 395 of the Civil Code of the Republic of Kazakhstan, a public offer is a proposal containing all the essential terms of the Agreement, which expresses the intent of the person making the proposal to conclude the Agreement on the terms stated in the proposal with anyone who responds to it). Agreement with the terms of the offer means payment for the ordered goods/services/works at the prices and in accordance with the terms specified on the site.
3.5. [sic] The Site contains materials protected by copyright, trademarks, and other legally protected materials, including but not limited to: texts, video clips, photographs, and graphic images. It is prohibited to copy, reproduce, alter, edit, download, modify, decompile, transmit, or distribute in any form, on any information medium, in whole or in part, any components of the Site without the Provider's prior written consent.
3.6. In connection with any permitted use of the Site's materials or components: it is necessary to preserve the objects contained on the Site unchanged, including watermarks, marks, and other official notices and indications of copyright and exclusive rights ownership; attempts to alter such items, including for the purpose of destroying or changing any indications of the rightholder, are prohibited.
3.7. Use of Site elements without the Provider's permission, in any manner and for purposes other than those permitted by this Agreement, is unlawful and may result in liability under the legislation of the Republic of Kazakhstan. Communication between the Visitor/User/Buyer and the Provider must be based on the principles of generally accepted morality and communication etiquette. The use of obscene language, profanity, offensive expressions, as well as threats and blackmail, is strictly prohibited, regardless of the form in which they are made or to whom they are addressed.

4. Registration and Placing an Order4.1. To place an Order, the User must provide the Provider with accurate information (full name, e-mail, etc.).
4.2. After payment, the Guide is sent to the Buyer's e-mail.
4.3. The User bears the risk of incorrectly provided information.

5. Payment and Delivery of the Guide5.1. The price of the Guides is indicated on the Site.
5.2. The Provider has the right to change prices without notice.
5.3. The Provider does not collect or store bank card data.
5.4. Delivery of the Guide is considered completed at the moment it is sent to the Buyer's e-mail.

6. Refund Terms6.1. No refund is issued after the Guide has been sent to the e-mail.
6.2. The fact of sending is confirmed by the Provider's technical data.

7. Intellectual Property7.1. All materials on the Site are subject to the Provider's copyright.
7.2. It is prohibited to copy, distribute, transmit, publish, or use the materials without the Provider's written permission.
7.3. Unlawful use of the materials entails liability under the legislation of the Republic of Kazakhstan.

8. Communication with the Provider8.1. The User agrees to observe standards of morality and etiquette. Insults, threats, and blackmail are prohibited.
8.2. By registering on the Site, the Buyer gives consent to receive updated information and informational messages with the latest news, new offers, special offers, and sales announcements, as well as information about the Provider's news and offers via SMS and e-mail.
8.3. The Buyer may choose their mailing preferences or opt out of the mailing list.

9. Processing of Personal Data9.1. Processing is carried out in accordance with the Law of the Republic of Kazakhstan "On Personal Data and Their Protection."
9.2. Data is processed in order to fulfill the order, send the Guide, communicate with the User, and compile statistics.

10. Collection of StatisticsData is collected in de-identified form.
Disagreement with data collection is grounds for discontinuing use of the Site.

11. Limitation of Liability11.1. The Provider does not guarantee uninterrupted operation of the Site.
11.2. The Provider is not liable for an incorrectly provided e-mail address, provider outages, or the actions of third parties.
11.3. No warranties, limitation of liability: the User uses the Site at their own risk. The Site is provided "as is."
11.4. The Provider assumes no liability whatsoever, including for the correspondence of the Site's content to the goals of the Visitor/User/Buyer.
11.5. The Provider does not guarantee that: the Site meets/will meet the requirements and expectations of the Visitor/User/Buyer; access to the Site will be provided continuously, quickly, reliably, and without errors. Any information and/or materials the Visitor/User/Buyer accesses through the Site are used at the Visitor's/User's/Buyer's own risk, and they are solely responsible for any consequences of using such information and/or materials, including any damage this may cause to the Visitor's/User's/Buyer's computer or to third parties, loss of data, or any other harm.
11.5. [sic] The Provider is not responsible for the operation of the establishments listed in the Guide. The Buyer must independently verify the operation of such establishments.

12. Applicable Law12.1. All relations are governed by the legislation of the Republic of Kazakhstan.
12.2. Disputes are resolved in the court at the Provider's place of registration.
